GENERAL TERMS & CONDITIONS
SAFETY DURING WALKS
While we may have a relationship with your dog and an understanding of his/her personality, we cannot guarantee the actions of other dogs we come across on walks. Accordingly, Adventure Tails will not encourage leashed socialization/meeting other dogs while walking, for the overall safety and enjoyment of the visit.

RELATIONSHIP AND RESPONSIBILITIES
• Adventure Tails will commit to a positive reinforcement approach, without any use whatsoever of aversive methods. The Client agrees to notify Adventure Tails of any concerns with Adventure Tails' services within 24 hours of the service.
• The Client is responsible for supplying the necessary equipment to perform services requested. This includes properly-fitted flat collars with identification tag, harnesses (if used), leashes, basket muzzles (if required) and weather appropriate clothing in good repair. Extendable “Flexi” leashes, prong collars, choke chain collars, static and/or shock collars, citronella collars, and other aversive equipment will not be used by Adventure Tails at any time or under any circumstance. Failure to provide appropriate items will prohibit the walk from occurring.
• In the case of emergency, inclement weather or natural disaster the Client authorizes Adventure Tails to use his/her reasonable judgement for the care and well-being of the Client's pet(s) and/or house.
• Adventure Tails will supply appropriate waste bags and will remove the dog's feces from all public places.
• Adventure Tails reserves the right to walk other compatible dogs at the same time (group walks only) but undertakes to limit the number of dogs walked with one person to four (4).
• The Client will ensure the dog has been fully vaccinated against Rabies and will maintain this vaccination as current during the Term of this Agreement. The Client will ensure the dog is on a flea/tick preventative treatment, as prescribed by a veterinarian. The Client understands that certain diseases, including without limitation Bordetella (kennel cough), are not vaccine preventable and can be contracted through no fault of Adventure Tails.
• It is expressly understood that walkers employed by Adventure Tails are not dog trainers, and positive training methods relative to dog walking and visits will be limited in scope and are not intended to address behaviour. Adventure Tails shall not be obliged to perform any other duties except those specified in this Agreement and on the Client Profile sheet.
• The Client gives Adventure Tails authorization to enter the listed address as needed to perform the necessary services and authorizes this contract to be valid approval for services.
• The Client and Adventure Tails mutually agree to provide the other party with a minimum of two weeks' notice for forthcoming vacation periods during which time dog walking will not occur. For vacations longer than 4 weeks, Adventure Tails will try its best to accommodate, however; cannot guarantee the Client's regularly scheduled spot will be held.

SUBSTITUTE WALKERS
• Where Adventure Tails needs to cancel a scheduled walk/pet sit due to illness, inclement weather or unforeseen circumstances, s/he may appoint a substitute Walker/pet sitter with written notice given to the Client (it is understood that email or text messages are acceptable modes of written authorization). In an emergency circumstance, notice may be given via telephone.
• In some cases, visits may be shortened to accommodate emergency scheduling. In very rare cases, walks may be cancelled if no emergency walker is available. Notice of these arrangements will be given as soon as possible.
• Adventure Tails shall assign another Walker/pet sitter to the dog/cat based on geographical location, best fit and ease of scheduling. All Walkers/pet sitters are insured and bonded and protected by this Agreement. Should a Walker through Adventure Tails be unable to provide a service, Adventure Tails may recommend another approved company.
• For clients on a regularly scheduled ongoing basis Adventure Tails agrees to transition any new Walker with an introduction to the Client (if desired) and dog (through a walk) should schedules change and Walkers be reassigned.

FEES FOR SERVICES
• The Client shall select the desired services as part of the Client Profile. Services can be agreed to on a weekly or as-needed basis and adjusted based on the needs of the Client and availability of Adventure Tails. All arranged services will be agreed to by email, phone call, text, or through the dog walking/pet sitting App.
• All fees for services performed are as outlined in the Client Profile and are subject to change with 30 days' notice.
• Payment for services rendered are required by Sunday of each week. The Client will receive an invoice reflecting amount currently owing each Thursday to reflect services rendered Monday to Friday of that week. This Agreement shall be valid approval for future services provided for by this Agreement permitting Adventure Tails to accept telephone or email or text reservations for service, and enter premises without any additional authorization.
• Adventure Tails shall levy a fee of $25.00 for any cheque returned for non-sufficient funds. In the event two cheques are returned for non-sufficient funds, the Client will agree to pay for subsequent services weekly in advance in cash, or Adventure Tails can choose to terminate the contract immediately.
• Unless otherwise arranged, should fees remain outstanding for 2 weeks (2 billing periods), an email reminder will be sent. Should fees not be paid within 48 hours of notification, Adventure Tails will temporarily put services on hold until payment is remitted. The Client takes responsibility for prompt payment of fees.
• Interac email transfer (preferred), cash or cheque are acceptable methods of payment. Interac email transfers may be sent to laurie@adventuretails.ca and cheques may be written out to Adventure Tails Dog Walking Service.

CONTRACT EFFECTIVE DATE AND TERMINATION
This Agreement shall come into effect the date the CLIENT clicks "Agree and Submit" on this policy agreement
OR
1) Immediately without notice for cause as a result of any aggressive or dangerous pet behaviour, or any unwelcome conduct by Client towards Adventure Tails and/or the Walker as determined by Adventure Tails in its sole discretion.
2) Either party may terminate this Dog Walking/Pet Sitting Contract with a minimum of 24 (twenty-four) hours prior to the first scheduled visit without incurring any fees.

CANCELLATION POLICY
• Cancellation by the Client of scheduled walks with less than 24 hours' notice will be charged at the full rate.
• For pet sitting services cancelled by the Client within 14 days of the service start date, Client will be responsible for 25% of the invoice for booked services. Services cancelled with less than 48 hours' notice prior to service start date will be charged 50% of the invoice for booked services. This also applies to services that are cut short, for instance, if the Client returns early and cancels remaining services.

EXTREME COLD/HOT WEATHER POLICY
In the best interest of both the Client's dog and Adventure Tails, walks may not occur if the temperature is below -25 degrees Celsius (inclusive of wind chill), or above 35 degrees Celsius (inclusive of humidex), or during weather conditions where high winds, heavy snow, heavy rain or thunder and lightning prevent normal walking conditions. These conditions constitute inclement weather.
In the event of inclement weather, the dog will be given an outdoor break at the Client's place of residence, and then the duration of the time will be spent socializing indoors. Environment Canada warnings will serve as a basis for action required. Where Client's dog is part of a group walk, Adventure Tails will spend 20 minutes at the Client's place of residence to allow for an outdoor break and some play time.

INCLEMENT WEATHER
In cases of dangerous weather (E.g. tornado, hail, freezing rain), walks/visits may be cancelled to ensure walker and dog safety. Please ensure you have emergency options should Adventure Tails be unable to visit your dog. In the case of dangerous weather alerts, we will attempt to notify clients by 8am the day of cancellation.

SOLICITATION OF ADVENTURE TAILS WALKERS/PET SITTERS
Client agrees that the walker/pet sitter provided by Adventure Tails is employed through Adventure Tails and is contracted to work only through Adventure Tails and not directly through the individual Client listed above. Client agrees that all reservations for present and future dog walking or pet sitting must be made through Adventure Tails and not the individual walker. Client is aware that the Adventure Tails walker/pet sitter may give out his/her personal number to the Client. Client agrees to use this number only in the event of an emergency during which the walker is already employed directly through Adventure Tails for the Client. The Client agrees that this number shall not be used for any solicitation of future dog walking or pet sitting.

LIABILITY
• Adventure Tails will carry liability insurance relative to the services performed for the Client.
• Adventure Tails accepts no liability for any breach of security or loss of or damage to the Client's property if any other person has access to the property during the time of this Agreement.
• Adventure Tails shall not be liable for any mishap of any nature that may befall a dog or cat, or other pet, or caused by a dog or cat or other pet who has unsupervised access to the outdoors.
• The Client acknowledges that his/her dog will never be let off leash for any reason, except for any medical emergency or while in or on the Client's premises, provided such premises are adequately secured with appropriate barriers to prevent escape.
• The Client hereby acknowledges that he/she has voluntarily agreed to pay for dog walking/pet sitting services as outlined in the Client Profile and understands that the act of walking/pet sitting his/her dog, cat and/or other pet, and any socialization/interaction with other people or animals involves risks of injury to other people, the Client's pet, and other pets, which risks are entirely the Client's responsibility. The Client expressly assumes all these risks and further expressly agrees to be solely responsible for any injuries incurred or cause by their dog(s)/cat(s). The Client further understands that dogs/cats, irrespective of their training and usual past behaviour or characteristics, may act or react unpredictably at times based upon instinct or circumstances, and agrees to assume the risk of injury to or caused by the Client's dog/cat. Additional risks include, but are not limited to: dog/cat diseases, dog/cat fights, dog/cat bites and/or injuries to humans and other dogs/cats; dog/cat escape over and under fences; vegetation which may have burrs or seeds that could become tangled in a dog's coat or lodge in a dog/cat's feet, ears, nose, or eyes; mosquitoes, ticks, wasps, fleas or other insects may be present; wild animals such as skunks, raccoons, porcupines, or stray dogs or cats could be present, all of which might injure or infect their dog/cat. The Client understands and expressly assumes all additional risks. By signing this Agreement, in consideration of all dog walking/pet sitting sessions or socialization that their dog may participate in, the Client hereby and fully and forever releases and discharges Adventure Tails Dog Walking Service and Walkers and anyone who may claim indemnity from same, including without limitation her employees, contractors and assigns from any and all claims, demands, damages, rights of action, or causes of action present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of intended use of said dog walking and socialization services. The Client fully and forever releases and discharges Adventure Tails without limit, including employees and assigns from any and all negligent acts and omissions in the same, and intends to be legally bound by this agreement. The Client has carefully read this release of liability and understands and fully agrees with its contents.
• Adventure Tails is not responsible for any damage to the property or home of the Client, unless such damage is caused by the willful neglect of Adventure Tails.
• Adventure Tails is not liable for any loss or damage in the event of a burglary or other crime that should occur while under this Agreement. The Client agrees to secure the home prior to leaving the premises. Adventure Tails will make best efforts to re-secure the home according to Client instructions at the end of each visit. If the home cannot be re-secured, Adventure Tails will contact the Client to advise.
• The Client is solely responsible for pet-proofing the house and yard and security fences/gates/latches. Adventure Tails will not be responsible for the safety of the pet(s) and will not be liable for the death, injury, disappearance or legal consequences of any pet(s) with unsupervised access to the outdoors.
• Adventure Tails and its staff shall not be responsible for any animal(s) that instigate fights with other animals or is injured by another animal while in Adventure Tails' care. Adventure Tails will take all appropriate actions to ensure that the Client's animal(s) are not placed in the company of aggressive or violent animals and/or will immediately remove Client's animal(s) from any animal fight.
• The Client and Walker are aware that the highest level of care shall be given to any and all pets under care of the dog walker/pet sitter employed by Adventure Tails. The Client is aware that pet(s) are instinctive in nature and not always controllable by Adventure Tails even when the highest level of care is provided. Should the Client's animal(s) run away or be injured, the Client agrees that Adventure Tails will not be responsible for any liability. The above waiver of liability in favor of Adventure Tails shall not apply or be effective if Adventure Tails conduct in providing its pet care services is found to be grossly and willfully negligent.
• The Client will be responsible for all medical expenses and damages resulting from an injury to dog walker/pet sitter or other persons by the Client's pet(s). Client agrees to pay the full cost of any and all medical expenses and damages should they arise to the Adventure Tails Walker/pet sitter or the Walker/Sitter possessions as a result of the Client's animal(s) actions. The Client shall indemnify, hold harmless, and defend Adventure Tails in the event of a claim by any person injured by the Client's pet(s).

EMERGENCIES
• In the event of an emergency, Adventure Tails shall contact the Client at the numbers provided to confirm the Client's choice of action. If the Client cannot be reached timeously, Adventure Tails is authorized to:

o Transport the dog(s)/cat(s) to the listed veterinarian
o Request on-site treatment from a veterinarian
o Transport the dog(s)/cat(s) to an emergency clinic if the previous two options are not feasible.

SECURITY
Adventure Tails warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Client and to return same to the Client at the end of the contract period or immediately upon demand.

UPDATES AND SOCIAL MEDIA
We will provide written updates and photo(s) about our visit with your dog/cat via text, email or the dog walking application. Please be advised you may not receive updates promptly at the end of your dog/cat's visit, nor can we guarantee a prompt response should you reply to the update.

Adventure Tails has an active Facebook and Instagram page, and we encourage you to “Like” it to see photos of your dog/cat's walks/visits. No addresses or Client names are posted unless explicit consent to do so is given.

You acknowledge and agree that any photos/images or video of your dog(s)/cat(s) taken by Adventure Tails are solely owned by Adventure Tails, and that Adventure Tails reserves the right to publish such photos/images/videos on its website(s) and/or social media sites, and otherwise use such photos/images/videos for any marketing purposes in its sole discretion.

PRIVACY POLICY
Adventure Tails is serious about the confidentiality, integrity and security of your personal information. We believe that treating your personal information with the highest degree of respect and security is integral to our relationship with you as a Client. We collect information to serve you and your dog(s)/cat(s). The information we collect is necessary to ensure the safety, security, and comfort for you, your home, your dog(s)/cat(s), and the contractors/employees of Adventure Tails. Your personal information will never be shared or used for any purpose other than to keep an accurate record of the pertinent details required to walk and/or service your dog(s) needs as described in this Agreement. Only contractors/employees of Adventure Tails will have access to any information collected. Information about you or your pet is collected from our interactions with you and your pet. Interaction may include a phone call, text, email, message though our dog walking App, direct interaction or other means of social media currently available. No matter how we collect your personal information, we try to ensure its accuracy and completeness. In order to maintain the integrity of your information, please make sure we are aware of any changes to your personal information in writing as soon as possible.

RELAXATION OF TERMS
No relaxation, indulgence, waiver or release by any party of any of the rights and terms of this Agreement on one occasion shall prevent the subsequent enforcement of such rights and terms shall not be deemed to be a waiver of any subsequent breach of any of the terms.

WHOLE AGREEMENT
This Agreement constitutes the sole and entire agreement between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged, expressed or implied provision not contained therein. Any alteration to this Agreement must be in writing and signed by both parties.

ASSIGNMENT
No party may assign any of its rights or delegate or assign any of its obligations in terms of this Agreement without the prior written consent of the other party, except where otherwise stated herein.

BINDING EFFECT
The terms of this Agreement shall be binding upon and accrue to the benefit and be enforceable by either party's successors, legal representatives and assigns.

GOVERNING LAW
This Contract and Agreement shall be construed, interpreted and governed in accordance with the laws of the Province of Ontario and should any provision of this Agreement be judged by an appropriate court as invalid, it shall not affect any of the remaining provisions whatsoever.

TERMS AND AUTHORIZATION
The terms of this Agreement apply to all pets owned by the Client, including any and all new pets that the Client obtains on or after the date that this Agreement was signed, at any and all locations the Client designates for service.
